Terms of Service

1. Acceptance of Terms

By accessing or using ShiftPro ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including workspace owners, managers, and employees.

2. Description of Service

ShiftPro is a cloud-based workforce management platform that provides employee scheduling, time tracking, timesheets, clock-in/out functionality, and related tools for small and medium businesses. Features vary by subscription plan (Essentials, Professional, Advanced).

3. Accounts & Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your login credentials
• You must be at least 16 years old to use the Service
• One person or entity may operate multiple workspaces
• Workspace owners are responsible for the data entered by their managers and employees

4. Subscription & Billing

ShiftPro offers a free 30-day trial. After the trial, continued access requires a paid subscription. Subscriptions are billed monthly through Stripe. You may cancel at any time — access continues until the end of the current billing period. We reserve the right to change pricing with 30 days' notice.

• Essentials — Up to 10 employees, core scheduling & time tracking
• Professional — Up to 30 employees, advanced features including in-app support
• Advanced — Unlimited employees, all features including client management

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other accounts or systems
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the Service or its infrastructure
• Scrape, crawl, or harvest data from the Service
• Impersonate another person or entity
• Use the Service to send unsolicited communications (spam)

6. Data Ownership

You retain ownership of all data you enter into ShiftPro. We do not claim any intellectual property rights over your content. You grant us a limited license to store, process, and display your data solely for the purpose of operating the Service.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance.

8. Limitation of Liability

To the fullest extent permitted by law, ShiftPro and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or in connection with your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

You may close your account at any time. We may suspend or terminate your access if you violate these Terms or engage in activity that threatens the security or integrity of the Service. Upon termination, your data will be retained for 90 days before deletion, unless longer retention is required by law.

10. Indemnification

You agree to indemnify and hold harmless ShiftPro and its operators from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or an in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Illinois, United States. Any disputes arising under these Terms shall be resolved in the courts of DuPage County, Illinois.
